These terms of use (the “Terms”) govern your access to and use of Teaching & Learning Alliance (“TLA”) websites and products and services. Please read them carefully. By using the TLA’s web site or products and services, you accept to be bound and abide by these Terms and our Privacy Policy, found below. You will be asked to confirm this affirmative consent in a click box before using TLA products or services. If you do not agree to these Terms or the Privacy Policy, you must not access or use TLA products or services provided by this website.
Your privacy is very important to us and we won’t sell, share or rent this information to others, except in the ways outlined below. TLA collects information from our users at several different points on teachinglearningalliance.org in order to verify valid users and is the sole owner of the information collected on this site.
We reserve the right to change these Terms and our Privacy Policy at any time, subject to limitations imposed by applicable law. Such changes may be made without prior notice but will be explained in this Privacy Policy. If required by applicable data protection and security laws, TLA will seek your consent to any material change in how we use your personal information before that change takes effect. Changes will be effective when posted.
Security
This web site takes every precaution to protect our users’ information. When you submit sensitive information through the web site, your information is protected both online and offline. When a registration/order form asks you for information such as credit card number, the info is encrypted (meaning it’s turned into a mess of useless data) before it leaves your computer. Once it arrives here, we have the code that can sort out the data, and we’re the only ones with the code, which changes constantly. We use the encryption software Secure Socket Layer, or SSL.

We could tell another company, for example, that 85 percent of teachinglearningalliance.org web site visitors took our reading survey and here are the results, but we can’t say that you clicked on the reading survey (even if you did).
At times, we may partner with other service providers to provide specific services. When you sign up for these TLA-sponsored services, we will share your name or other contact information, as necessary, to the third party that provides these services. Third parties are not allowed to use personally identifiable information except for the purpose of providing these services.
Third Party Websites
This web site contains links to other sites, but TLA is not responsible for the privacy practices of other sites. If another web site asks for personal information, you should to that site’s own privacy policy.
Surveys
Sometimes our site requests information from users via surveys. Participation in these surveys is voluntary and you may choose whether or not to disclose this information simply by not taking the survey. Examples of information a survey could ask for include your name and address, as well as demographic information, such as your zip code or age.
Email Opt-in/Opt-out
TLA issues quarterly association newsletters to those of our users that subscribe to receive them. If you wish to subscribe, we ask for contact information, such as name and email address. If at any point after you subscribe you no longer wish to receive our newsletters or other promotional materials from our service providers, you may opt-out of receiving these communications by replying to unsubscribe in the subject line in the e-mail or by sending an e-mail to [email protected]
Exceptions: Certain types of e-mail correspondence don’t have opt-out capabilities, such as billing emails, and other web site and service announcements.

The information posted on the web site is owned by TLA or someone else and cannot be reproduced or otherwise used by you without the owner’s permission.
Where you are given the opportunity to post information or pictures to the web site for viewing by others, be sure that such information or pictures are not inaccurate, unlawful or infringing upon the rights of others.
Please don’t interfere with other TLA members’ privacy expectations by scraping or otherwise using their personal information, our code, etc. for your own (or anyone else’s) commercial or non-commercial purposes.

Screen scraping or using other means to extract Web Site Content or data in bulk from this web site or its related applications is strictly prohibited.
Information provided by you.

Collection of Information.
We do not collect, use, or disclose any information about users of our web site or products and services except as described in this Privacy Policy. This Privacy Policy seeks to comply with all applicable data security and practice laws, including, but not limited to, the U.S. Privacy Act, the Children’s Online Protection Privacy Act, the California Consumer Privacy Act, and all other applicable state laws.
What Information do we collect?
We collect information from you when you subscribe to our newsletters or purchase one of the services or products available on our website. When subscribing or ordering on the web site, you may be asked to enter information such as: name, e-mail address, shipping address, phone number, job title or company name. You may, however, visit the web site anonymously. Following a transaction, the only private purchase-related information that we will retain on our servers is your shipping address and email address.

What do we use your information for?
The personal information we collect from you may be used in any one of the following ways:
- To improve our web site and product and service offerings.
- To improve customer service.
- To process transactions. Your personal information, whether public or private, will not be sold, rented, or leased to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested.

How long do we keep your information/data for?
Unless otherwise stated herein, TLA will retain and use your information as necessary for legitimate business reasons, including as needed to comply with our legal obligations, to resolve disputes, and to enforce our agreements. When we have no ongoing legitimate business reason to process your information, we will either delete or anonymize it or, if this is not possible, then we will securely store your information and isolate it from any further processing until deletion is possible.
How can you manage or delete your personal information?
You can submit a request to [email protected]. Once you do, TLA will provide you with information about whether we hold any of your personal information. You may access, correct, update or request deletion of your personal information by emailing us at [email protected]. We will respond to your request within a reasonable timeframe and in accordance with applicable data protection laws.
Children’s Online Privacy Protection Act Compliance
TLA is in compliance with the requirements of the Children’s Online Privacy Protection Act (COPPA). TLA does not collect any information from anyone under 13 years of age. TLA’s Web site and services are all directed to people who are at least 13 years old. TLA’s Online Protection for Children Privacy Policy can be found at www.teachinglearningalliance.org/coppa.
Do Not Track Clause
Teachinglearningalliance.org does not track its users or customers over time and across third-party websites to provide targeted advertising and therefore does not respond to Do Not Track (“DNT”) signals. However, some third-party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, your web browser may allow you to set the DNT signal so that third parties know you do not want to be tracked.

Web Site Content (other than that which you provide) is owned by TLA and its licensors. The Web Site Content is intended solely to provide business information to authorized users of the web site. Infringement policy.
TLA, pursuant to 17 U.S.C. Section 512 as amended by Title II of the Digital Millennium Copyright Act (the “Act”), reserves the right, but not the obligation, to terminate your use and access of the web site if it determines in its sole and absolute discretion that you are involved in infringing activity, including alleged acts of first-time or repeat infringement, regardless of whether the material or activity is ultimately determined to be infringing. TLA accommodates and does not interfere with standard technical measures used by copyright owners to protect their materials. In addition, pursuant to 17 U.S.C. Termination or suspension of this Agreement or your access rights shall not affect any right or relief to which TLA or its subsidiaries may be entitled, at law or in equity. Upon termination, all rights granted to you will terminate and revert to TLA and its licensors.
Modification.
TLA reserves the right to amend these Terms, with such amendments becoming effective upon notice thereof, which may be provided to you by posting on the web site, via e-mail or any other reasonable means. Continued use of the web site by you shall be deemed to indicate your acceptance of any such amendments. TLA also reserves the right to modify, add or discontinue any aspect, content or feature of the web site at any time without notice to you.
Non-U.S. access.
This web site is controlled and operated by TLA from its offices within the Commonwealth of Massachusetts, in the United States of America. TLA makes no representation that the Web Site Content is appropriate or available for use outside the United States. Those who choose to access this web site from outside the United States do so on their own initiative and are responsible for compliance with any applicable local laws. Software from the web site is further subject to United States export controls. No software from this web site may be downloaded or otherwise exported or re-exported (A) into (or to a national or resident of) Cuba, Iraq, Libya, North Korea, Iran, Syria, or any other country to which the U.S. has embargoed goods, or (B) to anyone on the U.S. Treasury Department list of Specially Designated Nationals or the U.S. Commerce Department’s Table of Deny Orders. Governing Law.
These Terms, use of TLA products and services, and the Privacy Policy will be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without giving effect to any principles of conflicts of law.
Miscellaneous.
These Terms and the Privacy Policy, along with any posted operating rules constitute the entire agreement (the “agreement”) of the parties with respect to the subject matter hereof, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between the parties with respect to such subject matter. To the extent of any conflict between these Terms and any terms and conditions in a subscription agreement concerning TLA products and services, the terms and conditions in the subscription agreement shall govern. These Terms create no third-party beneficiary rights. You may not assign any of your rights, obligations or privileges here under without the prior written consent of TLA. Any assignment other than as provided for in this agreement shall be null and void. TLA’s failure to enforce a provision is not a waiver of its right to do so later. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this aAgreement and shall not affect the validity and enforceability of any remaining provisions. No waiver by either party of any breach or default hereunder shall be deemed a waiver of any subsequent breach or default.
